Terms of Use & Liability Waiver

1. Acceptance of Terms
By creating an account or using the MatStrength application or website (together, "the Service"), operated by Mat Strength LLC, you agree to be bound by these Terms of Use and the Liability Waiver below. If you do not agree, do not use the Service.
2. Not Medical, Nutrition, or Other Professional Advice
Mat Strength LLC is not a medical provider. Neither MatStrength, its owners, employees, contractors, nor any coach using the Service is acting as your physician, registered dietitian, nutritionist, physical therapist, psychologist, or other licensed healthcare provider, and no provider-patient or professional-client relationship is formed by using the Service. All programming, nutrition targets, readiness scores, and other content are general educational information only — not medical advice, diagnosis, treatment, or a personalized nutrition or medical plan.
You are solely and fully responsible for your own health, physical condition, and nutritional decisions. Consult a physician before beginning this or any exercise program, particularly if you are pregnant, are new to exercise, or have a history of injury, heart or respiratory conditions, or other medical concerns. Consult a registered dietitian, nutritionist, or physician before making significant changes to your diet, and before using any calorie, macro, or weight-cutting guidance in the Service if you have — or have had — an eating disorder or disordered eating. Stop exercising immediately and seek medical attention if you experience pain, dizziness, chest pain, shortness of breath, or other discomfort. If you have any question or concern about your health, nutrition, or fitness to train, talk to a qualified professional before relying on anything in the Service — do not rely on MatStrength in place of that advice.
3. Assumption of Risk
Strength training, conditioning, wrestling, Brazilian Jiu-Jitsu, and related physical activities are inherently dangerous and carry risk of serious injury, permanent disability, or death. You voluntarily choose to perform the activities described in the Service and you knowingly and freely assume all such risks, both known and unknown.
4. Release of Liability
To the fullest extent permitted by law, you release, waive, and discharge Mat Strength LLC, its members, officers, employees, contractors, coaches, and content contributors (collectively, "Released Parties") from any and all claims, demands, causes of action, damages, or losses — including those for personal injury, illness, disability, death, or property damage — arising out of or related to your use of the Service or performance of any exercise, technique, program, or recommendation contained in it, whether caused by negligence of the Released Parties or otherwise.
5. Indemnification
You agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another person.
6. Technique Content
Wrestling and BJJ techniques shown or linked in the Service should only be practiced under the supervision of a qualified coach, with appropriate mats, safety equipment, and training partners. Never practice submission holds, chokes, or takedowns without proper supervision. Third-party videos linked from the Service are the property of their respective owners.
7. Weight Management and Eating Disorders
Any nutrition target, calorie range, or weight guidance in the Service is general information, not individualized medical or dietetic advice. The Service will not prescribe a rate of weight loss it considers unsafe, but you remain solely responsible for your own weight management decisions. Rapid weight cutting can be fatal. Work with a physician and a qualified coach before cutting weight for competition. If you have, or have ever had, an eating disorder or a difficult relationship with food or weight, talk to a physician or eating-disorder specialist before using the Service's nutrition or weight-cutting features, and stop using them if they affect your health or wellbeing.
8. Your Responsibilities
You acknowledge and agree that you — not Mat Strength LLC — are solely and fully responsible for your own health, safety, and physical condition while using the Service, on and off the mats. You are responsible for the accuracy of the information you enter, for using proper equipment in good repair, for training within your own limits, and for keeping your account credentials secure. The Service's load, nutrition, and readiness recommendations are estimates, generated from the data you provide — you alone decide what weight to put on the bar, what to eat, and whether a given session is appropriate for you that day.
9. No Warranty; Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE. WE DO NOT GUARANTEE ANY PARTICULAR FITNESS, WEIGHT, OR PERFORMANCE OUTCOME.
TO THE FULLEST EXTENT PERMITTED BY LAW, AND EXCEPT FOR THE ASSUMPTION OF RISK AND RELEASE OF LIABILITY IN SECTIONS 3–4 ABOVE (WHICH APPLY WITHOUT ANY DOLLAR LIMIT), THE RELEASED PARTIES' TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. NOTHING HERE LIMITS LIABILITY WHERE THE LAW DOES NOT ALLOW IT TO BE LIMITED.
10. Eligibility and Minors
You must be at least 13 years old to create an account. If you are between 13 and 17, you may use the Service only with the involvement, consent, and supervision of a parent or legal guardian, who must review and agree to these Terms — including the Assumption of Risk and Release of Liability above — on your behalf before you train. A parent or guardian who permits a minor to use the Service is agreeing to these Terms, including that release, in their own capacity and on the minor's behalf, to the extent permitted by law. Some jurisdictions limit what rights a parent can waive for a minor; where that is the case, this section applies only to the extent the law allows.
11. Subscriptions and Billing
Certain content requires a paid subscription. Subscriptions purchased on this website are billed by Stripe and renew automatically until cancelled; you can cancel at any time from your account page, and access continues through the end of the period already paid for. Subscriptions purchased inside the mobile app are billed by the Apple App Store or Google Play and must be cancelled through your device's subscription settings. See our Refund Policy. Program content may be added, changed, or retired over time.
12. Accounts and Termination
You must provide accurate account information and you may not share your account. We may suspend or terminate an account that violates these Terms, abuses the Service, or attempts to circumvent access controls.
13. Intellectual Property
All programming, written content, branding and software in the Service are owned by Mat Strength LLC. Your subscription grants you a personal, non-transferable licence to use them. You may not redistribute, resell, or republish program content.
14. Dispute Resolution
If a dispute arises out of these Terms or the Service, you agree to first contact us at matforgestrength@gmail.com so we can try to resolve it informally. Nothing in this section limits either party's right to bring an individual claim in small claims court.

16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
17. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the rest remain in full force and effect, and the unenforceable provision will be interpreted to best accomplish its intent within the limits of applicable law. These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Mat Strength LLC regarding the Service.
18. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules.
